Terms and Conditions

§ 1 Scope
(1) These Terms and Conditions (hereinafter "Terms") govern all contracts between Oliver Lieven, Alfred-Delp-Weg 3, 73765 Neuhausen, Germany (hereinafter "Provider") and the customer (hereinafter "Customer") regarding the use of the Dokmatiq platform and the DocGen API (hereinafter "Service").
(2) Deviating terms and conditions of the Customer are not recognised unless the Provider expressly agrees to them in writing.
§ 2 Subject matter
(1) The Provider makes a REST API for document generation, processing and conversion available to the Customer (DocGen API).
(2) The exact scope of functionality is defined by the current API documentation at api.dokmatiq.com and the chosen plan.
§ 3 Registration and access
(1) Use of the Service requires registration in the developer portal. The Customer must provide truthful information and keep access credentials (especially API keys) confidential.
(2) The Customer is liable for all activities performed under their credentials unless the misuse is not attributable to the Customer.
§ 4 Free tier and paid plans
(1) The Service can be used under a free tier with a limited monthly allowance.
(2) Paid plans are billed monthly. Current pricing is available in the developer portal.
(3) Payment processing is handled by Stripe. By subscribing to a paid plan, the Customer accepts Stripe's terms of service.
§ 5 Availability
(1) The Provider strives for uninterrupted availability but does not guarantee uptime under the free tier.
(2) Maintenance windows are announced in advance where possible. Current status is available at status.dokmatiq.com.
§ 6 Usage rights and restrictions
(1) The Customer receives a simple, non-transferable right to use the Service under these Terms.
(2) The Customer must not:
- use the Service to generate unlawful content,
- use the API in a way that impairs operation for other customers,
- share credentials or make API keys publicly accessible,
- circumvent security measures or reverse-engineer the Service.
§ 7 Data and documents
(1) The Customer retains ownership of all data and documents processed through the Service.
(2) The Provider processes documents solely to deliver the Service and deletes input and output data after processing unless the Customer has configured explicit storage.
(3) The Provider creates regular backups but does not guarantee data recoverability. The Customer is responsible for maintaining their own backups.
§ 8 Liability
(1) The Provider is fully liable for damages arising from injury to life, body or health, and for intentional misconduct and gross negligence.
(2) For slight negligence the Provider is only liable in case of breach of essential contractual obligations (cardinal obligations), limited to the foreseeable, contract-typical damage.
(3) Liability for data loss is limited to the typical recovery effort that would have existed had the Customer made regular, appropriate backups.
§ 9 Termination
(1) The free tier can be terminated at any time without notice by deleting the account.
(2) Paid plans can be cancelled at the end of the current billing period.
(3) The right to extraordinary termination for good cause remains unaffected.
§ 10 Changes to these Terms
(1) The Provider may amend these Terms with reasonable notice. Changes will be communicated to the Customer by email.
(2) If the Customer does not object within 30 days of receiving notice of the changes, the amended Terms are deemed accepted. This consequence will be pointed out in the change notification.
§ 11 Final provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Stuttgart.
(3) If any provision of these Terms is or becomes invalid, the remaining provisions shall remain unaffected.
